BEEHIVE VENTURES LLC d/b/a BEECAPTURED PORTRAITS PHOTOGRAPHY SERVICES AGREEMENT

This Photography Services Agreement ("Agreement") is made and entered into by and between Beehive Ventures LLC, doing business as BeeCaptured Portraits ("Company," "We," "Us," or "Our"), and the undersigned client ("Client," "You," or "Your"). By booking our services, Client agrees to the following terms and conditions:

1. SERVICES PROVIDED BeeCaptured Portraits agrees to provide professional photography services as outlined in the agreed-upon package, including but not limited to studio, portrait, event, commercial, and lifestyle photography. Specific deliverables, session duration, and inclusions will be determined by the package selected by Client.

2. OWNERSHIP & USAGE RIGHTS (a) Ownership of Digital Assets: All photographs and digital assets captured, edited, or developed by BeeCaptured Portraits remain the exclusive property of Beehive Ventures LLC ("Company"), even if purchased by the Client.

(b) Client Rights: The Client is granted a non-exclusive, non-transferable license to use purchased photos per the package terms. If a package includes full ownership rights, those rights will be explicitly stated within the purchase terms.

(c) Credit & Attribution: The Client may not claim ownership of or falsely represent the photos as their own. Any use of photos on social media or public platforms must include proper credit to BeeCaptured Portraits, such as tagging our business page or mentioning our brand in written captions.

(d) Commercial Use: Commercial use of any photographs or digital assets requires a separate licensing agreement and additional fees.

3. BOOKING, PAYMENT & CANCELLATION (a) Booking Confirmation: A non-refundable deposit is required to secure a booking. The remaining balance must be paid in full before the session date, unless otherwise agreed upon in writing.

(b) Cancellation by Client:

• More than 30 days before session: Refund minus the non-refundable deposit.
• 15-30 days before session: 50% refund of the total booking amount.
• Less than 14 days before session: No refund.

(c) Rescheduling: If rescheduling is requested at least 14 days before the scheduled session, BeeCaptured Portraits will accommodate a new date, subject to availability, within 3 months of the original date. Rescheduling less than 14 days before the session may be subject to a $50 fee.

(d) Cancellation by Company: If BeeCaptured Portraits must cancel due to unforeseen circumstances, a full refund including the deposit will be provided. If rescheduling is necessary due to weather or other uncontrollable factors, we will offer an alternate date at no additional cost.

4. LIABILITY & INDEMNITY (a) Client Responsibility: The Client is responsible for the conduct of all session participants. Any damages caused to equipment, props, or the studio space due to negligence or misconduct will be the Client’s responsibility and subject to additional fees.

(b) Limitation of Liability: BeeCaptured Portraits shall not be held liable for any personal injury, property damage, loss, or claims arising from the use of our services.

(c) Indemnification: The Client agrees to indemnify and hold harmless BeeCaptured Portraits, its employees, and agents from any claims, demands, or damages related to the photography session.

5. MARKETING & PROMOTIONAL USE (a) Company’s Right to Use Photos: BeeCaptured Portraits reserves the right to use any photographs, GIFs, and other media captured during the session for promotional, marketing, or portfolio purposes, including but not limited to social media, website content, and print materials.

(b) Opt-Out Clause: If the Client wishes to restrict the Company’s use of their images for marketing, a written request must be submitted prior to booking.

6. MISCELLANEOUS (a) Severability: If any provision of this Agreement is found to be invalid, the remaining provisions shall remain in full force and effect.

(b) Modification: We reserve the right to update these Terms at any time. Any changes will be communicated to the Client before the session.

(c) Entire Agreement: This Agreement constitutes the entire understanding between the parties regarding photography services and supersedes any prior agreements or understandings.

By booking a session with BeeCaptured Portraits, the Client affirms that they have read, understood, and agreed to these Terms.
